This Privacy Policy applies to Servco Australia Morningside Pty Ltd and the trading entities above, ABN 29 127 812 604 (the Dealer, we, our). We are part of a group of companies that includes Servco Australia Pty Ltd ACN 123 482 717 and its subsidiaries (the Servco Australia group).
The Dealer is committed to protecting the privacy of our customers, employees, and partners, and to complying with the Australian Privacy Principles under the Privacy Act 1988 (Cth) (Privacy Act) and other applicable laws.

Acceptance of Privacy Policy

What is personal information?
Personal information is defined in the Privacy Act as information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not, and whether the information or opinion is recorded in a material form or not.

If requested by you for the purpose of obtaining finance and/or insurance, we may also collect information on behalf of third party financiers and brokers such as details of your assets, liabilities, employment and income details, pay slips, tax statements and other financial information and credit information. How does the Dealer collect and hold personal information?
The Dealer collects personal information from:

- our suppliers, contractors and related entities;
- the manufacturer of a vehicle that we sell to you;
- referees that you may provide in support of an application for employment; and

- to manage warranties, recalls, services and repairs;
- to conduct customer satisfaction surveys;

- to develop and improve our products, services and content;

- for security and occupational health and safety purposes;
- if you have applied for a job with us, to assess your suitability for the role, including verification of your identity, qualifications, certifications and entitlement to work, and we may also conduct background or criminal history checks;

The Dealer never uses any sensitive information for direct marketing purposes.
Disclosure of personal information to other parties
The Dealer may disclose personal information to other individuals and organisations, such as:
- our related entities and bodies corporate forming part of the Servco Pacific Inc. corporate group which includes the Servco Australia group;
- our service providers, contractors and suppliers;
- financiers and/or insurers to whom you ask us to submit an application for finance and/or insurance on your behalf;
- other third party suppliers who we arrange to provide products and/or services to you;
- valuers;
- vehicle registries;
- the manufacturer of a vehicle that we sell to you;
- other dealers within the Servco Australia group's network;
- our professional advisers (e.g. lawyers and accountants);
- debt collection agencies;
- law enforcement officers, regulators, courts and government agencies, if permitted or required:
- by law, regulation, court order or other legal process;
- to assist in the prevention or detection of crime, or where a test drive vehicle or loan vehicle is involved in any parking or traffic infringements or is damaged while in your possession;
- to prevent a threat to any person's life, health or safety; and
- any purchaser or prospective purchaser of or investor in our business, including in the case of bankruptcy, a merger, acquisition, reorganisation, sale of assets or shares, or due diligence in respect of any such transactions.
We do not disclose any of your personal information to any credit reporting bodies and do not request any information about you from credit reporting bodies.
Disclosure outside of Australia
The Servco Australia group's servers are hosted in Australia, the United States of America, Singapore and Japan. Additionally, the Servco Australia group may disclose personal information to related entities and bodies corporate in the United States of America and Hong Kong, and to contractors in the Philippines. Servco Australia group takes reasonable steps to protect personal information that is disclosed overseas including through vendor diligence and imposing contractual obligations.
We may also need to send your information overseas to process transactions you have instructed us to make, such as international money transfers. The countries to which we disclose your information will depend on the transaction details.
You consent to any disclosure of your personal information outside of Australia on the understanding that if the overseas recipient handles the personal information in breach of the Australian Privacy Principles, the entity will not be accountable under the Privacy Act, and you will not be able to seek redress under the Privacy Act. The overseas recipient may not be subject to privacy obligations or any principles similar to the Australian Privacy Principles. Individuals may not be able to seek redress in some overseas jurisdictions, and overseas recipients may be subject to a foreign law that could compel the disclosure of personal information to a third party, such as an overseas authority.
Government related identifiers
The Dealer does not use any government related identifiers, such as passport number or driver's licence number, as its own identifier of any individual. The Dealer will not use or disclose any government related identifiers other than in accordance with the Privacy Act.
Data integrity and security
The Dealer takes reasonable steps to ensure that the personal information that it collects, uses and discloses is accurate, up-to-date and complete. We encourage individuals to assist us with this by contacting us if you are aware that any of your personal information is not accurate, up-to-date or complete.
The Dealer takes reasonable steps to protect personal information it holds from misuse, interference and loss, as well as unauthorised access, modification or disclosure.
When the Dealer no longer requires personal information for any purpose for which the information may be lawfully used or disclosed under the Australian Privacy Principles, we take reasonable steps to destroy the information or ensure that it is de-identified, except if the information is part of a Commonwealth record or the Dealer is required by law or a court or tribunal order to retain the personal information.
Sensitive information
If you provide us with sensitive information about other individuals, such as sexual orientation or health information, please ensure that the individual or the individual's representative is aware of the disclosure and that he or she consents to the disclosure to the Dealer as well as to the handling of their personal information in accordance with this Policy. Otherwise, you must not provide us with any sensitive information about other individuals.
De-identified data
You consent to us using and disclosing your de-identified data (information that no longer identifies you) for any purpose, including, without limitation, statistical analysis, product or service development, marketing and business planning or any other commercial purpose. We undertake technical measures to ensure that this data cannot be associated back to you.
Automated decision-making systems
In limited circumstances, we may process your personal information using semi or fully automated decision-making systems, being any computer program or artificial intelligence, to make, or do something that is substantially and directly related to making a decision that could significantly affect the rights or interests of an individual. e.g. using a copy of your driver's licence to upload into ID confirmation or verification software to affirm your identity.
Opting out of direct marketing communications
To opt out of receiving direct marketing communications from us, or to request that we do not disclose any of your personal information for the purpose of facilitating direct marketing by other organisations, please notify our Privacy Officer in writing and we will remove you from our marketing database. The Dealer does not impose a charge for making a request for access. However, we may charge for reasonable administrative costs incurred in providing access.
The Dealer encourages individuals to advise our Privacy Officer if your personal information requires correction or updating. The Dealer does not impose any charge with respect to requests for correction or updates.
Before correcting or providing access to personal information in response to a request, the Dealer will require your identity to be confirmed.
Requests for access or correction may be refused upon the grounds contained in the Privacy Act. If we refuse to provide access, or to correct personal information, the Dealer will provide you with reasons for the refusal.
Minors and Children’s Privacy
Servco does not and does not intend to transact with individuals under the age of 18. Individuals under the age of 18 must only communicate and transact with us with the involvement of a parent or legal guardian. Individuals under the age of 18 must not submit any personal information. Anyone providing any personal information to us must declare they are over the age of 18.
Complaints and requests for information
A person who wishes to complain about a breach of the Australian Privacy Principles by the Dealer should contact our Privacy Officer. General requests for information from individuals or government agencies can be directed to our Privacy Officer.
The Dealer will not impose any charge for making or dealing with a complaint, or for providing the information requested. Complaints and requests for information will be acknowledged by our Privacy Officer.
We will use our best endeavours to ensure that complaints and requests for information are actioned within 30 days from our receipt of the request. We will contact you if we need more time.

OneToyota organisations may send you marketing to inform you about products or services, special offers, promotions and events that may be of interest to you. These marketing communications may include joint promotions with promotion partners, and may be sent to you using any contact details provided by you, such as post, phone, email or SMS.
Please note that each of the OneToyota organisations are separate organisations. If you do not wish to receive marketing from one organisation, you can let that organisation know at any time using the contact details in their privacy policy (available on their website or at https://www.toyota.com.au/policies/privacy-policy) or using the "unsubscribe" or other opt-out function offered by the organisation.
